Appeal Court Jolts Ogah From Abia Governorship Dream, Voids His Return Certificate

The Court of Appeal on Thursday in Abuja jolted Uche Ogah from his dream of becoming Abia State governor as it set aside two judgments of the Federal High Court in Abuja, which on June 27 removed Dr. Okezie Ikpeazu as Governor.

A five-man panel led by Justice Helen Ogunwumiju, also quashed all the orders made in the two judgments by Justice Okon Abang, including the one directing the Independent National Electoral Commission to issue a fresh certificate of return to Uche Ogah.

Among other orders made by Justice Abang which was nullified by the Court of Appeal was the one directing the Chief Judge of Abia State to swear in Ogah as governor.

The appeal court delivered six judgments on six separate appeals challenging the judgments of Justice Abang on suit FHC/ABJ/CS/71/2015 filed by Ogah and the other, FHC/ABJ/CS/1086/2014, filed by Obasi Ekeagbara.

The learned Justices unanimously held that the trial judge engaged in “quasi justice” by denying Ikpeazu fair hearing, an act which it said amounted to “gross miscarriage of justice.”

All five justices on the appeal bench unanimously affirmed the four appeals filed by Ikpeazu and the PDP relating to the substance of the two cases.

Meanwhile, Ikpeazu has hailed the judgment, saying “it is a victory for democracy and the Abia electorates.”
