The Islamic Movement in Nigeria, IMN, otherwise known as Shi’ites, has filed a suit challenging the ex parte order of the Federal High Court in Abuja for its proscription.
The IMN filed the motion on notice on Friday, before Justice Nkeonye Maha of the Federal High Court in Abuja, seeking the reversal of the proscription order.
The group in the application filed on its behalf by Mr. Femi Falana (SAN) contended that the order was made without jurisdiction.
Justice Maha had issued the proscription order and designated it a terrorist group in a ruling delivered on July 26.
Mr. Falana averred that the court lacked the jurisdiction to issue the ex parte order against a non-juristic body like IMN which is not a registered entity.
He further said the order breached the fundamental right of all its members to fair hearing, guaranteed by section 36 of the Nigerian Constitution.
The ex parte order also violated its members right to freedom of thought, conscience, and religion, Falana added.
